Red Hat Finally Puts Shareholder Suit Behind It

An earnings dispute dating back to 2004 has finally been settled but it’s cost the company a senior executive and quite a bit of money in the process. So how much of a bite will it take out of Red Hat over this case? Linux Planet gets the details.


Some lawsuits take longer than others to settle — just ask Linux vendor Red Hat.

Today, Red Hat (NYSE: RHT) announced that it had reached an agreement to settle a class-action lawsuit from some of its shareholders that started back in July 2004.

Settling the lawsuit will cost Red Hat $8.8 million, which the company said it would take as a one-time charge when it reports earnings later this month for the quarter ending Nov. 30.

The lawsuit stemmed from Red Hat’s earnings restatement in 2004 that followed the resignation of then-CFO Kevin Thompson.

At the time, Red Hat restated three years’ worth of earnings as it changed the way it recognized revenues from software subscriptions. The move led to a decline in the value of Red Hat’s share price, which dropped by as much as 22 percent after it first announced the restatement.

Launching A New Product

On October 22nd, Small Business Trends announced the first in a series of videos that our very own, Anita Campbell, did for UPS (United Parcel Service) and provided a bit of the backstory behind the filming of the videos.

Today, we are pleased to announce the last video of Anita’s series titled, “Launching A New Product” in which Anita discusses the cycle of orchestrating the successful launch of a new product into the marketplace.

Anita says, “So, you’ve developed a new product?  You’re going to want a well coordinated launch plan.  Start planning early!  If the product is already rolling off the assembly line and being packed in boxes, you’re not leaving yourself enough time.”

When orchestrating a new product launch, there are so many factors to take into consideration.  Branding, logos, trademarks, packaging and much more.  Missing one or more of the necessary factors in a successful business launch can “make or break” your new product.  Taking the necessary time beforehand to properly prepare is crucial to the final success of your new product.

Anita says, “Keep your plans flexible.  You may need to make adjustments on the fly, but remember, those adjustments just might reveal hidden opportunities.”

CIT helps SMBs get more loans for less

CIT Group, which recently declared bankruptcy but is now undergoing reorganization, will waive the $1,000 packaging fee that comes with loan applications in an effort to establish itself as a top commercial lender. The fee waiver, already in effect, will last through March 10, 2010. Additionally, CIT Group will commit $500 million to support SMB lending operations next year.

“The small business sector remains a key driver of job creation in America,” said Chris Reilly, president of CIT small business lending. “These recent announcements reflect our commitment to bringing much needed credit to this sector, and to helping small businesses access the capital they need to weather this difficult economic environment.”

Helping small businesses could help the economy. CIT Group reports that SMBs employ nearly 59 million Americans today and collectively account for more than half of America’s non-farm private gross domestic product.

Small business owners put work before health

Nearly a quarter of small business owners put their work commitments before their health according to a survey carried out by Continental Research, on behalf of Abbey and Alliance & Leicester business banking.

Of the 300 small business owners reviewed companies with the most employees had the biggest problem getting to the Doctor. 41% of small firms with 11 or more employees admitted to missing, cancelling or delaying a medical appointment as a result of work commitments. In comparison only 9% of bosses that have as little as one or two employees put work before their health.

The study also revealed that bosses who work longer hours are much more likely to put business before their health.
